If you owe back taxes, have missing returns or just opened a letter about a levy, the ads start quickly: radio spots, mailers and phone calls promising to settle your debt for a fraction of what you owe. The FTC and the IRS have both warned consumers about companies that make those promises.

This list sticks to local Upstate offices you can visit. Each was checked on its own website, and each is described only by what that site says. We left out national call-center tax-relief companies on purpose.

One thing to know before you read on: representing you before the IRS in a collection case or an appeal requires a CPA, an enrolled agent or an attorney. Ask every firm, including the ones below, exactly who will sign the power of attorney for your case.

How we put this list together

  • Who represents you: a CPA, enrolled agent or attorney, named up front.
  • Whether the firm will also prepare the missing returns, since the IRS generally expects filing to be current before it agrees to most payment arrangements.
  • How fees are explained, and whether anyone promises an outcome only the IRS can decide.
  • Whether the firm handles South Carolina Department of Revenue matters as well as federal ones.

The site does not state the credentials of its staff, so ask who would represent you if your case moves into collection or appeals.

Red flags of tax-relief companies

The Federal Trade Commission and the IRS publish consumer warnings about tax-relief marketing. The IRS lists aggressive offer in compromise mills on its annual Dirty Dozen list of scams. Walk away if a company:

  • Asks for its whole fee upfront. The FTC says plainly that if a company tells you to pay the whole fee before it does anything, you should walk away.
  • Says you qualify for a program before seeing your finances. Only the IRS, or the state for state debt, decides who qualifies.
  • Promises you will pay pennies on the dollar, or quotes an average settlement. The IRS warns that offer in compromise mills push applications they know will be denied.
  • Charges ongoing monthly maintenance fees while your case sits.
  • Can't tell you which CPA, enrolled agent or attorney will represent you.

The IRS also points out that taxpayers who do qualify for an offer can get the same deal working directly with the IRS. Its free Offer in Compromise Pre-Qualifier tool shows whether you are likely to qualify, and the Taxpayer Advocate Service and Low Income Taxpayer Clinics offer free help to people who qualify.

What to do before your first consultation

  1. Gather every IRS and SCDOR letter, in date order, and note any response deadline.
  2. Make a list of the years you haven't filed.
  3. Create or sign in to your IRS online account to see balances and wage and income records.
  4. Keep paying current-year taxes, through withholding or estimated payments, so the balance stops growing.

Frequently asked questions

Who can represent me before the IRS?

CPAs, enrolled agents and attorneys have unlimited representation rights, meaning they can handle audits, collection matters and appeals. Other paid preparers can speak for you only on returns they prepared and signed, and not on collection issues or appeals. Can a tax resolution firm stop a wage garnishment?

A representative can ask the IRS to release a levy, usually by getting you into compliance and setting up a payment arrangement or showing hardship. Nobody outside the IRS can guarantee the result. Act quickly once you receive a final notice of intent to levy, because your appeal rights have deadlines. Our post on IRS wage garnishment explains the process.

Do I have to file all my missing returns first?

Usually yes. The IRS generally wants required returns filed before it agrees to most payment plans or an offer in compromise. A good firm will start by listing which years are missing and pulling your wage and income transcripts. See our back tax filing page for how that works.

Is it safe to call the number on a tax-relief mailer?

Be cautious. Check that the company has a real local office, ask who will represent you and in what capacity, and never pay the whole fee upfront. You can also contact the IRS directly using the number printed on your notice.
